These Terms constitute a legally binding agreement between you and Rocket Agent.

If you do not agree to these Terms, you must immediately discontinue use of our services. By engaging with our services, scheduling appointments, or utilizing any aspect of our platform, you affirm your acceptance of these Terms in their entirety.

These Terms apply to all users of our services, including without limitation buyers, sellers, prospective clients, and visitors to our website or digital platforms.

2. SERVICE DESCRIPTION

Rocket Agent provides modern, digital-first real estate services designed to create faster and more efficient experiences for both buyers and sellers. Our services include, but are not limited to:

Modern Buyer and Seller Experience: We deliver contemporary real estate solutions that leverage technology and streamlined processes to facilitate property transactions with enhanced speed and transparency.

Fast-Track Transaction Guidance: We provide expert guidance designed to accelerate the real estate transaction process while maintaining thoroughness and attention to detail throughout all stages of buying or selling property.

Digital-First Real Estate Support: We offer technology-enabled support services that prioritize digital communication, online document management, and virtual engagement options to meet the needs of today's real estate consumers.

Our services are designed to complement and enhance traditional real estate processes. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. Service availability may vary by location and property type.

Rocket Agent acts as a facilitator and advisor in real estate transactions. We do not guarantee specific outcomes, transaction timelines, sale prices, or purchase success. All real estate transactions are subject to market conditions, third-party cooperation, financing approval, and numerous factors beyond our control.

3. USER OBLIGATIONS

By using our services, you agree to:

Provide accurate, current, and complete information about yourself and your real estate needs during registration, consultation, and throughout our engagement.

Maintain the confidentiality of any account credentials or access information provided to you and accept responsibility for all activities that occur under your account.

Use our services only for lawful purposes and in accordance with these Terms and all applicable local, state, and federal laws and regulations.

Refrain from interfering with or disrupting the operation of our services or servers, or violating any requirements, procedures, policies, or regulations of networks connected to our services.

Not attempt to gain unauthorized access to any portion of our services, other users' accounts, or computer systems or networks connected to our services.

Communicate respectfully and professionally with our agents, staff, and representatives at all times.

Respond promptly to requests for information, documentation, or decisions that are necessary to advance your transaction.

Disclose any material facts, conflicts of interest, or circumstances that may affect the real estate transaction or our ability to represent your interests effectively.

Notify us immediately of any unauthorized use of your account or any other breach of security.

Failure to comply with these obligations may result in immediate termination of services without refund of any fees paid.

4. APPOINTMENT SCHEDULING AND CANCELLATIONS

Appointment Scheduling: You may schedule appointments with Rocket Agent through our website, email, phone, or other designated communication channels. All appointments are subject to availability and confirmation by our team.

Confirmation: Upon scheduling, you will receive a confirmation of your appointment via email or other agreed-upon communication method. It is your responsibility to ensure we have accurate contact information.

Cancellation Policy: If you need to cancel or reschedule an appointment, you must provide notice to us at least 24 hours in advance by contacting us at Britney.Shaw@tryrocketagent.com or through our platform. Cancellations made with less than 24 hours notice may result in cancellation fees or limitations on future scheduling privileges.

No-Show Policy: Failure to attend a scheduled appointment without prior notice constitutes a no-show. Multiple no-shows may result in suspension of services and may affect our continued representation.

Our Cancellations: We reserve the right to cancel or reschedule appointments due to emergencies, agent unavailability, or circumstances beyond our control. We will make reasonable efforts to provide advance notice and offer alternative appointment times.

Virtual and In-Person Appointments: We offer both virtual and in-person appointment options where available. The format will be confirmed at the time of scheduling and may be subject to change based on circumstances or health and safety considerations.

5. PAYMENT TERMS

Service Fees: Rocket Agent's compensation structure and fee arrangements will be clearly outlined in separate service agreements, listing agreements, or buyer representation agreements as applicable to your specific engagement.

Commission Structure: For real estate transactions, our compensation typically comes in the form of commissions paid at closing, as specified in your signed agreement. Commission rates and payment terms will be disclosed prior to entering into any representation agreement.

Additional Fees: Certain services may incur additional fees, including but not limited to rush services, specialized marketing materials, or premium service packages. Any such fees will be disclosed to you in advance and require your written consent.

Third-Party Costs: You may be responsible for third-party costs associated with real estate transactions, including but not limited to inspection fees, appraisal fees, title insurance, escrow fees, and other closing costs as outlined in your purchase or sale agreement.

Payment Methods: Payments, where applicable, may be made by methods we designate, including wire transfer, check, or through closing proceeds. All payments must be in United States dollars unless otherwise agreed in writing.

Late Payment: If any payment is not received by its due date, we reserve the right to charge interest on the overdue amount at the rate of 1.5 percent per month or the maximum rate permitted by law, whichever is lower.

Refund Policy: Commission and fee refund policies, if any, will be specified in your individual service agreement. Generally, fees for services rendered are non-refundable.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Rocket Agent, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, loss of opportunity, loss of data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of our services, even if we have been advised of the possibility of such damages.

Our aggregate liability to you for all claims arising from or related to our services shall not exceed the total amount of fees actually paid by you to Rocket Agent in the six months preceding the event giving rise to liability, or $500, whichever is greater.

We are not liable for:

Delays, failures, or interruptions in service delivery due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, labor disputes, or telecommunications failures.

Actions or omissions of third parties, including but not limited to other real estate agents, lenders, inspectors, appraisers, title companies, buyers, sellers, or other parties involved in real estate transactions.

Market fluctuations, changes in property values, or economic conditions affecting real estate transactions.

Your failure to provide accurate information, respond to communications, or fulfill your obligations under these Terms or separate agreements.

Any real estate transaction that fails to close for any reason, including but not limited to financing denial, inspection issues, or buyer/seller decisions.

Unauthorized access to or alteration of your transmissions or data due to circumstances beyond our reasonable control.

This limitation of liability is a fundamental element of the agreement between you and Rocket Agent. Our services would not be provided without these limitations.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in their entirety.

7. WARRANTY DISCLAIMERS

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, ROCKET AGENT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, AND ACCURACY.

We do not warrant that:

Our services will meet your specific requirements or expectations.

Our services will be uninterrupted, timely, secure, or error-free.

The results obtained from using our services will be accurate, complete, or reliable.

Any property you purchase will be free from defects or will meet your expectations.

Any property you sell will sell within a particular timeframe or at a particular price.

Any information, advice, or guidance provided through our services will result in successful real estate transactions.

Our digital platforms, website, or technology solutions will be free from viruses or other harmful components.

Real estate transactions are complex and subject to numerous variables beyond our control. We make no guarantees regarding outcomes, timelines, prices, or transaction success. Market conditions, property conditions, financing availability, and numerous other factors affect real estate transactions.

While we strive to provide accurate information and professional guidance, you acknowledge that you are ultimately responsible for your own decisions regarding real estate transactions. You are encouraged to conduct your own due diligence, obtain independent professional advice, and carefully review all documents and disclosures.

Any advice or information, whether oral or written, obtained by you from Rocket Agent or through our services does not create any warranty not expressly stated in these Terms.

Some jurisdictions do not allow disclaimers of implied warranties, so portions of the above disclaimer may not apply to you. You may have additional rights that vary by jurisdiction.

8. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws applicable to the jurisdiction in which services are provided, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms or our services shall first be addressed through good faith negotiations between the parties. You agree to notify us in writing of any dispute and allow 30 days for attempted resolution before pursuing formal legal action.

Arbitration: If negotiation does not resolve the dispute, both parties agree to submit the dispute to binding arbitration under the rules of the American Arbitration Association, unless otherwise prohibited by law. The arbitration shall be conducted in the jurisdiction where services were provided or as mutually agreed. Each party shall bear its own costs and fees unless otherwise awarded by the arbitrator.

Class Action Waiver: To the extent permitted by law, you agree that any proceedings to resolve disputes will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

Exceptions: Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights or confidential information.

Venue: For any disputes not subject to arbitration, you consent to the exclusive jurisdiction and venue of courts located in the jurisdiction where services were provided.

Real Estate License Compliance: Nothing in these Terms shall be construed to waive any rights or obligations under applicable real estate licensing laws and regulations.

You are responsible for maintaining current contact information with us. We are not liable for failures in communication resulting from incorrect or outdated contact information.

10. CHANGES TO TERMS

Rocket Agent reserves the right to modify, amend, or update these Terms of Service at any time at our sole discretion. When we make changes, we will make the updated Terms available through our website and digital platforms.

Notification: For material changes to these Terms, we will make reasonable efforts to provide notice through email, platform notifications, or prominent posting on our website. However, it is your responsibility to review these Terms periodically for changes.

Effective Date of Changes: Changes to these Terms will become effective immediately upon posting unless otherwise specified. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.

Existing Engagements: For active representation agreements or ongoing transactions at the time of a Terms modification, the version of the Terms in effect at the time of engagement will generally continue to apply to that specific transaction unless otherwise agreed in writing.

Right to Decline: If you do not agree with modified Terms, your sole remedy is to discontinue use of our services. Continued use following notice of changes indicates your acknowledgment and acceptance of the updated Terms.

Version Control: We maintain records of Terms versions. If there is a dispute regarding which version applies, we will refer to the version in effect at the time your service agreement was executed or when services were rendered.
